1. Provider and scope

These General Terms and Conditions (GTC) apply exclusively to direct bookings of the Panorama Studio and Family Apartment made through the Villa Larnia website. Bookings made through Booking.com, Airbnb, Vrbo or another booking platform are governed by the contractual terms of the relevant platform.

Any individual agreement expressly made between Villa Larnia and the guest takes precedence over these GTC.

2. Booking and formation of the contract

The accommodation and prices displayed on the website constitute an invitation to make a booking. The guest selects the accommodation, travel dates, rate and payment method and provides the information required for the booking.

Full payment is required immediately after the booking is submitted. An accommodation contract is formed only when payment has been completed successfully and Villa Larnia has confirmed the booking. The booking confirmation is sent to the guest electronically.

The person making the booking must be at least 18 years old and authorised to book on behalf of all accompanying guests. Minors may stay only with a responsible adult.

Obvious pricing, input or availability errors do not create a right to performance of an incorrect booking. Villa Larnia may reject or cancel a booking affected by such an error. Any amount already paid for that booking will be refunded in full; mandatory statutory rights remain unaffected.

3. Prices and payment

The total price displayed during the booking process includes all mandatory taxes for the booked accommodation and the final cleaning. No compulsory accommodation-related supplements will be added.

Optional services, such as an additional cleaning during the stay or an additional sauna session, are agreed only after the guest has been informed of any applicable charge.

Full payment is due immediately after booking and may be made by credit card through Stripe or by PayPal. A booking is not confirmed without successful full payment.

4. Rates and cancellation by the guest

4.1 Standard rate

A booking may be cancelled free of charge up to and including 14 calendar days before the agreed arrival date. From the 13th calendar day before arrival, 100% of the agreed total price will be charged.

4.2 Non-refundable rate

The rate expressly marked as “non-refundable” includes a 10% discount. The total price is payable in full immediately after booking. No refund is made if the booking is cancelled.

4.3 No-show and early departure

In the event of a no-show or early departure, the full total price remains payable. Unused nights are not refunded.

The agreed cancellation rules also apply if the guest is unable to travel because of illness, flight cancellation or other personal circumstances. Guests decide for themselves whether to take out travel cancellation insurance.

Cancellations should be made in text form, in particular by email to info@villalarnia.org, quoting the booking number. The time at which Villa Larnia receives the cancellation determines whether the deadline has been met.

5. No statutory right of withdrawal

Under Article 103(l) of Spanish Royal Legislative Decree 1/2007, there is no statutory 14-day right of withdrawal for contracts for accommodation provided on a specific date or during a specific period. The voluntary free-cancellation option for the standard rate under section 4 remains unaffected.

6. Changes to travel dates

Travel dates may be changed free of charge, subject to availability, up to and including 14 calendar days before the originally agreed arrival date.

From the 13th calendar day before the originally agreed arrival date, a change is possible only subject to availability and only if the new stay includes at least the same number of nights. No surcharge is charged for a more expensive new travel period. There is no entitlement to particular replacement dates; a change becomes effective only when confirmed by Villa Larnia.

7. Arrival and departure

Check-in is available from 15:00 to 23:00 on the arrival date. A later arrival is possible only by prior arrangement and subject to availability.

Check-out must take place by 11:00 on the departure date. A later check-out is possible only on request and subject to availability.

8. Statutory guest registration

All guests aged 14 or over must provide the statutory registration details fully and accurately and complete the required registration before arrival. For younger guests, the accompanying adult provides the information required by law.

Identity documents must be shown for verification or provided through the legally prescribed procedure when requested. Villa Larnia may refuse check-in until the required registration has been completed. A resulting inability to use the accommodation does not release the guest from the payment obligation.

9. Occupancy and visitors

Only guests named in the booking and properly registered may stay overnight. Additional overnight guests are not permitted because the approved maximum occupancy of each apartment must be observed for safety reasons.

Day visitors are permitted without prior approval but may not stay overnight. The pool, sauna and other Villa Larnia facilities are reserved exclusively for booked overnight guests.

Subletting or otherwise transferring the accommodation to third parties is strictly prohibited.

10. House rules

Guests must treat the accommodation, grounds, furnishings and neighbourhood with care and consideration.

The following rules apply in particular:

  • Pets are not permitted in the apartments or anywhere on the Villa Larnia grounds.
  • Smoking and vaping are prohibited throughout the Villa Larnia grounds. By prior express permission, an exception may be granted in the pavilion in the palm garden; an ashtray will then be provided.
  • Celebrations, parties, events and noisy gatherings are prohibited.
  • Quiet hours from 23:00 to 08:00 must be observed.
  • Commercial use and photo or film productions are strictly prohibited without prior written permission.
  • Apartment doors and windows must be closed properly when guests leave. The shared guest entrance must be locked again after every use.
  • Bicycles and sports equipment may not be stored inside the buildings.

In the event of a serious or repeated breach, in particular unauthorised overnight guests, parties or substantial disturbance, Villa Larnia may terminate the stay early after an unsuccessful warning. No prior warning is required where there is an immediate danger or a particularly serious breach. Unused nights are not refunded in such a case. Mandatory statutory rights remain unaffected.

11. Pool and sauna

The pool and sauna are used at the guest’s own responsibility. Villa Larnia’s statutory safety and liability duties remain unaffected.

The pool is approximately 1.60 metres deep throughout and is suitable only for swimmers. Children must be supervised by a responsible adult at all times in the pool and sauna area. Swimwear is compulsory during normal pool use.

A sauna session should preferably be requested one day in advance and may last for a maximum of three hours. The sauna cabin holds no more than four people. During a confirmed sauna session, the entire spa area becomes the exclusive private area of the guests who reserved it and may be used until 23:00. During this period, the pool and sauna may be used without swimwear. Persons under 18 may use the sauna only when accompanied by an adult.

For stays of at least one week, one sauna session per booked week is included without an additional charge. For shorter stays and additional sessions, preparation costs a flat rate of €30 for the entire guest group. Sauna towels, infusion and drinks are prepared.

12. Barbecue area

Use of the barbecue area should preferably be requested one day in advance. Barbecue utensils, grills and charcoal are provided without an additional charge; guests bring their own food.

Barbecuing is permitted from 08:00 to 23:00 only when no official ban on open fires is in force and Villa Larnia has confirmed use in advance. Guests dispose of the waste they create; Villa Larnia carries out the remaining cleaning.

13. Cleaning and consumables

Final cleaning is included in the total price. An additional cleaning during the stay may be arranged on request. Any applicable charge will be communicated in advance.

The consumables provided on arrival are intended as an initial supply sufficient even for a longer stay. They are not normally replenished during the stay.

14. Damage, keys and exceptional cleaning

Guests must report damage, loss or malfunction immediately. Under the applicable statutory rules, guests are responsible for damage, loss and exceptional cleaning costs culpably caused by them or their visitors.

If keys or other access devices are lost or damaged, the actual replacement costs and, where necessary for security reasons, the reasonable cost of replacing a lock will be charged.

Villa Larnia does not require a security deposit. This does not affect a guest’s responsibility for damage culpably caused by them.

15. Defects and temporary disruptions

Any apparent defect, outage or complaint must be reported to Villa Larnia immediately so that it can be addressed as quickly as possible. Guests should give Villa Larnia a reasonable opportunity to inspect and remedy the issue.

Uninterrupted availability of Wi-Fi, electricity, water, the pool or other facilities cannot be guaranteed in the event of circumstances outside Villa Larnia’s control. Villa Larnia will make reasonable efforts to restore the service as quickly as possible. Mandatory statutory guest rights, particularly in the event of a substantial or unresolved impairment, remain unaffected.

16. Access in emergencies

Laura and Helmut hold a master key. During a stay, the apartment will be entered without the guest’s permission only in an emergency or where there is imminent danger, and only to the extent required to protect persons, the accommodation or the grounds.

17. Liability and personal belongings

Villa Larnia is liable in accordance with applicable law. Nothing in these GTC excludes or limits liability where doing so is prohibited by law, in particular in cases of intent, gross negligence or injury to life, body or health.

Villa Larnia is liable for loss, theft or damage to a guest’s personal belongings only where the loss is attributable to Villa Larnia under applicable law. No safe is provided in the apartments.

18. Inability of Villa Larnia to provide the accommodation

If Villa Larnia is unable to fulfil a confirmed booking, all amounts paid for that accommodation booking will be refunded in full.

Travel expenses, alternative accommodation or other consequential costs are reimbursed only where Villa Larnia is liable for them under mandatory law. Further statutory guest rights remain unaffected.

19. Complaints

Complaints may be submitted using the contact details in section 1. Official Canary Islands complaint forms (hojas de reclamaciones) are available at the accommodation.

Villa Larnia does not voluntarily participate in a private consumer arbitration procedure unless participation is required by law or expressly agreed in an individual case. Statutory rights to refer a matter to a competent authority or court remain unaffected.

20. Applicable law and jurisdiction

Spanish law applies. Mandatory consumer-protection provisions of the state in which the guest has their habitual residence remain unaffected where they apply under private international law.

The courts having jurisdiction under applicable law are competent to hear disputes. The courts of Tenerife have jurisdiction only where such an agreement is legally permitted in the particular case. Mandatory consumer jurisdiction rules, in particular those arising under European Union law, remain unaffected.

21. Contract language and translations

The language version made available to and accepted by the guest during the booking process governs. Translations are intended to convey the same legal content. Mandatory law remains unaffected.

22. Final provisions

If any provision of these GTC is or becomes wholly or partly invalid, the remaining provisions remain effective. The applicable statutory provision replaces the invalid provision. Individual agreements and mandatory statutory rights always remain unaffected.
